CollectorRegistry.com ("NQCR") operates from the Law Offices of William J. Judge. Since 1984, Mr. Judge has been a practicing attorney whose law practice concentrates on the issues related to drug and alcohol testing in the workplace. As a ten year faculty member of ACOEM and an advisor to ASAM, Mr. Judge is one of the most experienced legal advisors in the country on this topic. This service has developed as a response to the need created by the changes to "Part 40" which became effective in August of 2001.
CollectorRegistry.com is an online service that audits, archives and makes available drug test collector qualifications. NQCR does not charge for access to the documentation. The information is available online for any employer or TPA to access.
Federal rules state that "an employer's good faith use of a collector that is not qualified is no excuse and cannot serve as a defense to an enforcement action by DOT, or in an action by a former applicant or employee." The rules require collectors to produce written documentation of qualifications upon request. Employers must have documentation confirming several elements of collection personnel qualifications. Subsequently, Error Correction Training and Refresher Training must also be documented. Therefore, in order to fully document collector qualification and ensure compliance for all involved, NQCR has developed a comprehensive Individual Collection Site Personnel Qualification Survey. The Survey has been designed to capture all pertinent information and must be completed by each individual collector listed online for your site.
This is an on-line audit service that will relieve you of the burden of repeatedly faxing credentials to every employer or TPA requesting them. After registering, you simply direct all future queries to www.CollectorRegistry.com. Your collectors' credentials will be available, at no charge, to all employers/TPAs twenty-four hours a day. For just $99 per year you may register any and all collectors at a given location.
NQCR does not train collectors, do collections, or in any way compete with TPAs or providers in the drug testing industry. NQCR is in no way affiliated with any TPA and/or provider. As such, NQCR is a totally independent auditing entity.
Once you have completed the initial Audit and returned the materials to NQCR, any new personnel who become qualified as collection staff may be registered after having gathered and completed the equivalent documentation. You simply go to www.CollectorRegistry.com and enter the new collector's name, then transmit their documentation to NQCR via facsimile at no additional charge.
Your registration fee includes auditing your location on quarterly basis. However, once the initial Audit is complete, only a small amount of documentation regarding refresher training and/or error correction training will be required of existing personnel. A confirmation of existing collection site personnel will also be requested at each quarterly audit point.
One of the requirements of 49 CFR Part 40.33(a) essentially mandates that collectors keep current on changes to the rules governing drug and alcohol collection. Included in your registration fee, your office is receiving a subscription to Mr. Judge's comprehensive web site, www.DTStateLaws.com. Your subscription gives you access to a wealth of information on the legal issues related to testing, and as a subscriber, you will receive a weekly email informing you automatically of any changes to the rules.
Registered collection sites may post their services and hours of operation at no extra charge.
In addition, registered collection sites will receive Mr. Judge's newest publication. A companion to NQCR, this electronic quarterly newsletter will concentrate primarily on discussing collection issues. The inaugural issue will be published in July of 2003.
Now! The deadline for compliance with the rules was January 31, 2003. At this time all collectors should be qualified according to the rules. We will gladly provide you with a list of places where you can attain the required training. Register at NQCR upon completion.
